
This case took place in Coweta County Georgia. Our client V. R. was struck by a driver who was taking prescription drugs at the time of the collision. This driver had taken prescription medication and almost passed out while driving. This driver had been taking the medication for almost two weeks before the car accident. Instead of stopping at a traffic light, he drove through the intersection and struck the rear of her vehicle. This impact caused severe damage to her vehicle and caused her to hurt her back and neck. V. R. was taken by ambulance to the Piedmont Newnan Emergency Room. There she was diagnosed with cervical strain and lumbar strain. She sought follow up care from her Family Doctor and ultimately was seen by Dr. Matt Davis a local newnan chiropractor, working at Crossroads Chiropractic. Dr. Davis treated her for 4 months. Her injuries ranged from back strain, neck strain, and shoulder strain. V. R. had medical bills around $8,000. She also missed work for a significant period of time.
In addition to normal damages our office sought punitive damages because the defendant was DUI at the time of the collision. The defendant had been convicted of driving less safe. The defendant had borrowed his father in laws car. Since he was driving a borrowed car, the owners insurance considered him a permissive user or driver and covered him for the damages he caused in the collision.
Travelers insurance was the insurance company involved. Initially they offered an amount that did not consider the punitive damages, wanted to argue that the defendant's conduct was not that bad and that their were no punitive damages available. Also through fighting with them we found a higher policy limit than we were initially told. After their low offer on the claim, we filed a lawsuit against them. After some initial discovery we were asked to mediate the case. Through mediation we were able to substantially increase the insurance company's offer. By the close of the day, we had gotten the insurance company to increase their offer by fourfold. At that point my client decided to settle her case and will receive almost twice as much money in her pocket as the insurance company's first offer.
Our client stated afterwords that she now understood why we fought them so long and that it was definitely worth the wait.
