Atlanta DUI Victim Car Accident Case Result

     Lethonia was referred to our office by another attorney. That attorney did not handle personal injury claims and knew that handling a DUI victim's case was more difficult than an ordinary car accident claim.   Lethonia was involved in a car accident in Sandy Springs, Georgia in Fulton county. Lethonia was on I-285 east about to exit onto Northside Drive when he was struck from behind by the other vehicle. During a discussion with the other driver, Lethonia thought he smelled alcohol on the other driver's breath. Lethonia reported this to the 911 dispatcher when he spoke with her.
     The officer on the scene did not give the other driver a field sobriety test or make him take a Breathalyzer. Despite these complications, my office treated this as a DUI victim case. We aggressively pursued punitive damages against the defendant driver and convinced the insurance company that punitive were a factor in the case.
     Lethonia suffered injuries to his back and neck. He received treatment at Cobb Wellstar Hospital and was diagnosed with shoulder strain and cervical strain. He received followup treatment with the Accident Injury Centers of Atlanta (AICA). His therapy was at Perimeter Health Center.
