CPSC Sues Infant Recliner Manufacturer

Infants are among the most vulnerable among us, and when we buy products to use with our children we expect them to function as intended and also be safe. When consumer products designed for infants do not function as intended the results can often be catastrophic. Of particular concern to parents and regulatory agencies recently has been the use of infant recliners that have been shown to potentially cause fatal accidents infants whose parents use them. The United States Consumer Product Safety Commission (CPSC) filed an administrative complaint in late 2012 against Baby Matters, LLC in connection with accidents that were allegedly caused by their infant recliners. According to the complaint, several models of the company’s infant recliners were defectively designed, and also had inadequate instructions and warnings, posing a substantial risk of injury or death to infants. According to the agency, CPSC is aware of five fatalities in connection with the use of these devices, and also has received over 70 additional reports of children almost falling out of these products.

This is not the first time that Baby Matters has caught the attention of federal regulators; in July of 2010, the company and the CPSC issued a joint recall of owners of first generation baby recliners as well as an $80 coupon towards the purchase of a new model with new and improved instructions and warnings. The current action is regarding the second generation of the model at issue in 2010, as well as problems associated with another related product.

The complaint seeks to force Baby Matters to notify the public of the defects associated with its products as well as offer consumers a full refund.
