Georgia Pedestrian Killed after Domestic Dispute

The Georgia Department of Transportation (GDOT) Pedestrian Safety Action Plan reports that has over 100 pedestrian fatalities per year. GDOT estimated that 2012 pedestrian deaths would likely exceed those in 2011.

Of the pedestrian fatalities, 91 percent occur in the roadway and only 5 percent occur in marked crosswalks. According to GDOT, over half involve either an impaired driver or a distracted pedestrian.

Consulting a Clayton County attorney after an auto accident involving a distracted driver enhances a victim's ability to receive a reasonable settlement. If you have been injured in an automobile accident involving a distracted driver in Clayton County you should discuss your case with an auto accident attorney at the Law Offices of Shane Smith.

According to the Atlanta Journal-Constitution, a 23-year-old Georgia woman was indicted on one count of malice murder and two counts each of felony murder and aggravated assault, after she ran over a 23-year-old pedestrian.

The driver was allegedly in a heated argument with her ex-boyfriend when she attempted to leave his apartment complex. The victim was an innocent bystander not involved in the domestic dispute.

If a death is caused by the negligence of another then the decedent's family may be entitled to legal relief through a wrongful death lawsuit. If the investigation proves that negligence on the part of the driver was responsible for the pedestrian's death then there may be grounds for the victim's family to file a wrongful death claim.

You should hire an experienced Clayton County wrongful death attorney if you will file a lawsuit on behalf of a family member who died due to another's negligence. Call the Law Offices of Shane Smith for a free consultation.
