Local Distracted Driving Regulations Call Attention to Problem

Distracted driving accidents killed 3,092 people in 2010 according to the U.S. Department of Transportation. It is estimated that an additional 416,000 people were injured in automobile crashes involving a distracted driver.

Consulting a Gwinnett County attorney after an auto accident involving a distracted driver enhances a victim's ability to receive a reasonable settlement. If you have been injured in an automobile accident involving a distracted driver in Gwinnett County you should discuss your case with an auto accident attorney at the Law Offices of Shane Smith.

Some Gwinnett County cities have attracted attention for attempting to pass ordinances making distracted driving laws stricter. For instance, Villa Rica attempted to pass a bill that sought to reduce distracted driving by restricting texting, writing and eating while driving. The bill was rejected but it attracted attention to a growing problem.

According to a study by the Insurance Institute for Highway Safety (IIHS) regulations intended to reduce distracted driving have had little impact on distracted driving rates. The study indicated that texting bans have not reduced the statistical prevalence of distracted driving accidents. When the study was conducted there were 30 states and the District of Columbia with texting bans. Another 11 states had enacted legislation that was set to be implemented around the time the study was conducted. Researchers compared the number of insurance accident claims citing texting as an accident cause prior to and after enacting the texting ban in four states. The IIHS found that the number of accidents increased after the texting ban was enacted in three of the four states.

The researchers recommended that legislators re-evaluate the texting bans because they do not appear have the desired result of preventing texting-related accidents. According to a related newspaper article, the low probability of being caught and the lenient penalties do not create a deterrent.
