Sandy Springs pick-up driver charged with crash death of passenger

A pick-up truck driver was charged with vehicular homicide after his passenger was ejected from the truck bed and killed.
 
The crash occurred around 2pm on Monday, January 25. Jack Mize, 69, of Chamberlee was driving his pick-up truck in the westbound lane of I-285 ant New Northside Drive in Sandy Springs. Evilio Morales, 35, also of Chamberlee, was riding in the bed of the truck.
 
Mize sideswiped a Mercedes and lost control of his truck. The truck rolled and Morales was thrown from the truck.  He died from his injuries. Mize and a passenger in the cab of the truck received non-life threatening injuries.
 
Mize was charged with second-degree vehicular homicide and with a lane violation.
 
In Georgia, it is illegal for children under 18 to ride in the back of an uncovered pick-up truck while on the interstate. The law does not cover adults. However, passengers in the beds of trucks are unprotected and at risk of serious injury in the event of an accident.
