What is the difference between a criminal case and a Georgia civil wrongful death claim?

A criminal case is filed by the government to punish an individual or company who broke a law that resulted in an person's death.

A Georgia wrongful death claim is a civil dispute between the family of the deceased and the person or company whose negligence or wrongful act caused that person's death.  A family has the right to file a wrongful death lawsuit even if the party at fault was not convicted in criminal court.
