Feds Propose National Drug and Alcohol Clearinghouse for Truck Drivers

Truck drivers have a tremendous responsibility because of the very nature of their job. Often, they pilot 80,000-pound vehicles at highway speeds at mere feet from other drivers. In the event of an accident, the damage and injuries that result can be catastrophic, most often for drivers or occupants of other vehicles. It is no surprise, then, that the law takes alcohol and drug use by truck drivers extremely seriously. In addition to having limits that are significantly more strict than those set for other drivers, people who hold a commercial driver’s license may disqualify themselves from the privilege of driving by violating these laws. People injured by impaired truck drivers should discuss their case with a Peachtree City truck accident lawyer as soon as possible to determine whether they have a claim.

In an effort to improve highway safety, the Federal Motor Carrier Safety Administration (FMCSA) has proposed the creation of a drug and alcohol clearinghouse for all commercial driver’s license (CDL) holders. The clearinghouse would create a federal repository of records of CDL holders that either had a positive drug or alcohol test or a refusal of such a test. The agency argues that such a clearinghouse would help employers determine whether a driver is able to perform safety-sensitive duties. According to a press release, drivers would voluntarily consent to provide such information to employers. Those who refused would still be allowed to employed by the trucking company, but would not be able to perform certain functions, such as operating a commercial motor vehicle.
