In an effort to improve highway safety, the Federal Motor Carrier Safety Administration (FMCSA) has proposed the creation of a drug and alcohol clearinghouse for all commercial driver’s license (CDL) holders. The clearinghouse would create a federal repository of records of CDL holders that either had a positive drug or alcohol test or a refusal of such a test. The agency argues that such a clearinghouse would help employers determine whether a driver is able to perform safety-sensitive duties. According to a press release, drivers would voluntarily consent to provide such information to employers. Those who refused would still be allowed to employed by the trucking company, but would not be able to perform certain functions, such as operating a commercial motor vehicle.
