A woman who was struck and injured by an Atlanta drunk driver has been charged with failure to use a crosswalk. 
 
The Atlanta pedestrian car crash occurred at 12:32 a.m. in front of The Ivy, a restaurant on Roswell Street.  A woman was crossing Buckhead Street when was hit by pick-up truck.  The truck left the scene of the Atlanta accident.
 
An off-duty Atlanta police officer who was working as a security officer at the restaurant witnessed the accident and called for help.  The pedestrian was taken to Grady Memorial Hospital for treatment of injuries.
 
Police closed the street as they searched for the truck involved in the accident.  It was found in a parking lot near the restaurant with significant front end damage.  The driver was arrested and charged with driving under the influence and several traffic charges.
 
Despite the fact that the woman was jay-walking, she is only partly responsible for the accident.  Drivers have a duty to watch for pedestrians and avoid behaviors, such as drunk driving, that can cause an accident.  The woman may be still be eligible for compensation for her injuries.
