When attempting to show that management knew or should have known about a dangerous condition, it’s important to know where the employees were at the time of the fall and just before the fall. Therefore, in our spoliation letter we ask who was working, where they were working and where they were at the time of the incident. We evaluate this to see if an employee should have seen the dangerous condition. If someone was working on an end cap could they have seen the water on the floor? Were they walking while doing their inspection procedures, or was it near an open register where they could have seen the injury? At Walmart, should the greeters at the door have seen the substance in the floor? The positioning of the employees can greatly help us prove that management knew or should have known about the dangerous condition.
