 Almost every single slip and fall case receive an initial response from the insurance company stating “We’re going to deny this claim.” They do it so often that when I take one of these cases I actually assume they are going to deny the case because that’s just their standard procedure. Insurance companies denying your case or not agreeing to pay your medical bills really have no bearing on whether or not we will take your case or if you will actually get a recovery down the line. This just means that their default position is that they are not going to pay. Insurance companies know that many people won’t go to the doctor because they don’t have the money to pay the medical bills. They also know that a lot of lawyers won’t take the case if they know your case has already been denied.
