What Is The Plain View Doctrine?

In this video, Peachtree City slip and fall attorney Shane Smith explains the plain view doctrine. This doctrine can determine whether or not you can recover from a slip and fall or trip and fall accident.

If the item you tripped over or slipped on was visible enough for a reasonable person to see, then it is considered to be in plain view. The plain view doctrine states that, in this instance, you cannot recover. That whole standard is whether or not a reasonable person would have seen it. That’s when we take into consideration factors like if you were distracted, if something else was going on, or if something was in the way. All of these factors will be evaluated in determining whether you should have seen it or not.
