What Is A Spoliation Letter?

In this video, Atlanta premises liability attorney Shane Smith explains the importance of a spoliation letter.

A spoliation letter is a legal document that a lawyer sends to an insurance company or directly to a store where someone was injured.  This letter is critical in slip and fall cases because it requires the preservation of all evidence from the incident. Evidence can include testimony, documents, videos, and tangible objects.  Having evidence will help prove the case if it goes to court. However, once evidence has been destroyed, it becomes nearly impossible to win because the injured party is unable to prove their case.
