On October st, a fatal car accident occurred in Henry County, GA. It involved Ralph Marshall, a resident of Jonesboro, who drives a charter bus for Superior Transportation, based out of Atlanta. It was originally believed that another vehicle cut the bus off while driving on I-75 in Henry County. Local Car Wreck Attorney Shane Smith tries to prevent a car accident for a local resident while at lunch. On Wednesday, while at lunch Shane saw a car stall out at the the main intersection in Peachtree City. Knowing that a breakdown would cause a huge traffic jam there, Shane got out to try and push the car into a nearby parking lot. Fortunately, it was a downslope and wasn't that hard. The National Highway Traffic Safety Administration released statistics showing that nationwide more people are killed on rural roads than in urban areas. 21,000 fatal car accidents occur in rural areas, with only 16,000 in urban cities. Georgia has 700 fatal accidents in rural with 687 in urban areas. Tennessee has 607 in rural with 428 in urban areas. Officials list several reasons why this could be true: less maintanence, missing guard rails, faded yellow lines, more four way stops, flashing lights, sharper curves, and narrower roads. However, the common belief is that the lower seat belt usage on rural roads is what causes the higher death rate. Seat belt usage is between 60 and 65 percent on rural roads and 85 percent in urban areas. Studies show seat belt usage saves lives. They can drastically increase the chances of survival in a serious crash. Currently the Governor's Office of Highway Safety is working to increase seat belt usage in rural areas of Georgia and Tennessee.
On September 28, 2009 the Georgia Supreme Court decided that the statute of limitations in Georgia car accidents can be extended under certain circumstances. The Supreme Court decided that a Georgia Law "tolling" the statute for a victim of a crime applied to Georgia traffic offenses. This extends the length of time car accident victims have to file a claim or lawsuit if the criminal or traffic ticket was delayed in getting resolved. This can be extremely important in DUI victim cases or other car accident cases where the defendant fought the ticket in court. Single vehicle crash on Highway 78 in Stone Mountain Georgia results in 3 fatalities on October 13, 2009. Dekalb County authorities stated that 9 people were in the van at the time of the collision and no other vehicles were believed to be involved. EMT's had to cut the top of the van off to reach those injured inside. Six people were taken to Grady Hospital and the Atlanta Medical Center. The six remaining passengers were listed in critical condition. No further information is available at this time.

Atlanta DUI Victim Lethonia Case Results from a Car Wreck. Lethonia was referred to our office by an attorney who did not practice personal injury or take car accident cases. Lethonia was struck by a driver who he believed was DUI. Even though the officer did not perform a breathalyzer we pursued this case as a DUI victim case. We sought punitive damages in the case.
