My teenager was hit while crossing in a Roswell crosswalk; however, she was talking on her cell phone at the time. Can we still bring a claim against the driver for failing to yield to her?

Even if your daughter was talking on her cell phone while walking, if the driver was at fault, you most likely have a claim for damages. Although pedestrians shouldn’t text, talk, or use cell phones while walking, it is not illegal. Additionally, if she was crossing the street in a crosswalk with the pedestrian traffic signal, then it sounds like the driver is at fault for hitting her.
