L.B. Case Review with Attorney Jason Binette
Hello and welcome to this week’s case review. I’m Shane Smith from Shane Smith Law. Today, I’m talking with Jason Binette about a recently settled case where he achieved a strong result for our client, Miss L.B.
Who Miss L.B. Was Before the Crash
Miss L.B. was a 30-year-old woman, active and independent, simply driving down the road on US-64 in North Carolina when her life was abruptly disrupted.
How the Accident Happened
The crash occurred on March 19. Another driver was driving erratically and side-swiped Miss L.B.’s vehicle, causing her to spin off the roadway while the at-fault driver spun in the opposite direction. Evidence at the scene showed the driver blew a .20 BAC, more than double the legal limit in North Carolina.
Injuries and Medical Treatment
Miss L.B. suffered injuries to her shoulder, back, and knee. While she did not require ambulance transport, she went to the hospital and then treated locally with EmergeOrtho and Dr. Sonia Posse. Her injuries were significant enough to require thoracic medial branch blocks from T4 to T7, a clear indication of serious spinal involvement.
Why DUI Matters in a Case Like This
Because alcohol was involved, this case carried an aggravated and punitive element. In North Carolina, drunk driving opens the door to punitive damages, which are designed not just to compensate the victim, but to punish reckless conduct.
Jason and his team immediately dug deeper. They pulled records, reviewed the police report, and built a clear picture of the defendant’s intoxication and dangerous behavior. That leverage mattered.
The Result
Due to the DUI nature of the crash and the clear liability, Jason was able to secure the full $50,000 policy limits in a remarkably short timeframe. The accident occurred in March, and the case was resolved by late June.
Key Takeaway from This Case
When alcohol or impairment appears in a police report, speed and strategy matter. Identifying intoxication early and aggressively pursuing records can significantly change the value and timing of a case.
Final Thoughts
Miss L.B. received a strong and timely resolution because the facts were developed early and pressure was applied where it mattered. This case is a reminder that drunk driving cases deserve immediate and serious legal action.
