Semi-Truck Collision Leads to Several Broken Bones For Our Client
Hi, I’m Shane Smith from Shane Smith Law. Today, I’m joined by one of our attorneys, Tim Lewis, to talk about a client victory involving a devastating semi-truck collision and a disputed insurance claim.
How the crash happened
Our client was a passenger in a pickup truck traveling down the road when the driver failed to yield. As a result, a semi truck struck the pickup on the passenger side, exactly where our client was seated. The impact was severe and caused significant trauma.
Does fault matter for a passenger
Even though the driver of the pickup was at fault, that did not hurt our client’s claim. As a passenger, she was injured due to someone else’s negligence, and she still had full rights to pursue compensation.
The injuries
Because of the force of the semi-truck collision, our client suffered multiple serious injuries, including:
- Four broken ribs
- A serious concussion and head injury
- A broken arm
- A broken leg
These were life-disrupting injuries that required significant medical care and recovery time.
Insurance dispute and legal challenge
The insurance company initially attempted to deny coverage. Their argument was that the driver was not listed on the insurance policy. Tim dug into the policy language and discovered a key detail: the driver was acting as an employee and performing work duties at the time of the crash. Under the policy terms, that meant coverage applied.
After forcing the insurance company to acknowledge their own policy language, Tim was able to overcome the denial.
The result
Tim secured the full policy limits of $100,000 in this case. Because our client’s injuries were the most severe of all the passengers involved, she received the majority of the recovery. She was very happy with the outcome, and we consider this a clear client victory.
