T.P. Case Review with Carilyn Ibsen
In this week’s case review, Shane Smith spoke with Carilyn Ibsen of Shane Smith Law about a recently settled single-vehicle crash involving a young client, T.P., and how careful advocacy led to a six-figure settlement despite limited insurance and multiple injured passengers.
How the Accident Happened
T.P. was riding in a vehicle with several friends when the driver lost control. The crash involved only one vehicle, which flipped and left the roadway. Everyone in the car suffered serious injuries.
Unlike many car accident cases, this was not a situation where another vehicle caused the crash. Instead, the claim was made against the driver of the vehicle T.P. was riding in, who was also his friend. These cases require a more delicate approach because the claim is really against the driver’s insurance company, not the friend personally.

T.P. was rushed to the hospital after the crash and required surgery. He suffered a dislocated hip and a fractured hip, which are extremely painful and serious injuries, especially for someone so young.

Because T.P. is younger, his recovery progressed better than it often does for older clients. However, his progress was not automatic. As Carilyn Ibsen noted, T.P. was committed to his recovery and consistently followed through with physical therapy after being released from the hospital.
That commitment made a real difference. Many clients struggle after surgery once they leave the hospital, but T.P. put in the work, which helped him heal and get back as close to normal as possible.

This case presented additional challenges because multiple people in the same vehicle were injured. The insurance company assigned defense counsel to handle claims from everyone involved, and there was only a limited amount of insurance coverage available.
