At Shane Smith Law, we almost never recommend that injured clients speak with the insurance adjuster about the details of the accident or their injuries.
Here is the simple rule.
It is okay to talk about your vehicle and property damage.
You can discuss where the car is located, how it will be inspected, and what repairs are needed.
It is not a good idea to discuss:
- how the accident happened
- who you believe was at fault
- how you feel physically
- whether you think you are injured
Insurance adjusters work for the insurance company, not for you. Their job is to limit what the company pays. Early statements are often used later to question fault or minimize injuries.
If the insurance company needs information about the crash itself, you can simply provide a copy of the police accident report or have your attorney handle those communications for you.
Before answering questions about your injuries or the accident, it is always best to speak with a lawyer first.
