How the Accident Happened
The client, referred to as B.B., was driving home from work on the interstate and was stopped in traffic. While traffic was at a standstill, another driver approached at speed, mistakenly believing traffic was moving, and rear-ended B.B.’s vehicle.
The impact was significant. While the vehicle was not totaled, it sustained substantial damage, and the force of the collision caused immediate physical trauma.
Initial Injuries and Emergency Room Visit
B.B.’s first complaints focused on neck pain and head symptoms consistent with whiplash. He was taken to the emergency room, where those injuries were documented. At that early stage, the full extent of his injuries was not yet clear.
As days passed and the adrenaline wore off, additional symptoms emerged. B.B. began experiencing lower back pain, hip pain, and pain radiating into his legs. What initially seemed muscular required deeper evaluation to determine whether spinal involvement was present.
Concussion Symptoms That Developed Over Time
Although B.B. mentioned head pain at the emergency room, his concussion-like symptoms developed gradually. Over time, he began noticing memory issues and cognitive problems that had never existed before the crash.
This delayed onset is common with concussions. What starts as headaches can slowly evolve into more serious cognitive symptoms, including forgetfulness and difficulty concentrating. These symptoms became a major component of B.B.’s case.
Ongoing Treatment and Surgical Recommendation
B.B.’s medical treatment was extensive. He pursued chiropractic care and pain management, but his pain never fully resolved. Doctors eventually determined that he would need a serious spinal surgery to address the underlying issues.
The challenge was that the surgery, combined with the medical bills already incurred, exceeded the available liability insurance. At the same time, B.B.’s pain had improved enough that he decided surgery was not immediately necessary given his life circumstances. He planned to address it later if the pain worsened.
Balancing Medical Needs and Insurance Limits
About half of the available policy limits had already been consumed by medical bills. Proceeding with surgery at that point would have exhausted the policy without fully covering the cost of the procedure.
Working closely with B.B., the legal team balanced his medical needs with the realities of limited insurance coverage. The goal was to secure a settlement that reflected both his past treatment and his future medical needs without forcing unnecessary financial exposure.
Insurance Company Resistance and Final Outcome
When the firm demanded the full policy limits, the insurance company initially responded with an offer equal to only half the policy, an amount that did not even cover the existing medical bills.
After roughly a month of continued negotiation and pressure, the insurance company reversed course and tendered the full policy limits. This ensured that B.B. received every dollar available under the at-fault driver’s insurance coverage.
A Key Lesson From This Case
Insurance companies often resist paying for future medical care, even when doctors clearly recommend it. They prefer to focus only on treatment already completed.
This case shows why it is critical to document not just past injuries, but also future medical needs. Even when surgery is delayed, its necessity still carries real value in a personal injury claim.
