How the Accident Happened
The client, referred to here as DA, was involved in a serious head-on collision while towing a boat. Another driver crossed the center line and struck DA’s vehicle head-on. Because of the force of the impact, the collision did not stop with the initial crash.
The impact propelled the boat forward into the back of DA’s vehicle, creating a second violent collision. This secondary impact transferred additional force into DA’s body, significantly increasing the severity of his injuries. What began as one crash quickly became two, compounding the trauma to his spine and neck.
The Injuries and Medical Treatment
As a result of the crash, DA suffered serious neck and back injuries affecting multiple areas of his spine. Diagnostic imaging revealed bulging and herniated discs. After evaluation by a specialist, epidural steroid injections were recommended in an effort to manage pain and stabilize the injuries.
Unfortunately, the injections did not resolve all of DA’s symptoms. Ongoing pain and functional limitations remained, and additional treatment along with future care was recommended. Like many injured clients, DA began to experience treatment fatigue, despite the seriousness of his condition.
Insurance Pushback and a Low Initial Offer
From the start, the insurance company undervalued the case. According to John Mobley, the initial adjuster appeared inexperienced and failed to appreciate both the severity of the crash and the extent of DA’s injuries.
The first offer came in as a very low five-figure amount, which did not even come close to covering DA’s medical expenses, let alone his pain, suffering, and long-term impact. At that point, it was clear the case would require persistence and a strategic approach.
Building the Case the Right Way
Rather than rushing to settle, the legal team encouraged DA to continue treating and to follow through on the specialist’s recommendations. Additional medical documentation was obtained, and DA was sent for a second opinion to further clarify the extent of his injuries and future needs.
This additional medical evidence proved critical. Once the full scope of the injuries and recommended care was documented, the insurance company’s position changed dramatically.
What started as a low five-figure offer ultimately resulted in the insurance company tendering its policy limits.
