Know Your Rights After an Injury on Someone Else’s Property
Many people assume that if they are hurt on someone else’s property, the process will be straightforward. Unfortunately, that is often not the case. One of the most common mistakes people make after a slip and fall or trip and fall accident is not protecting their rights at the scene.
Here is what you need to know.
Injured at a Store, Restaurant, or Business?
If you are injured on someone else’s premises, such as a department store, grocery store, restaurant, or shopping center, the business will often ask you to complete an incident report. This report documents what happened, where it happened, and when it happened.
That incident report matters more than most people realize.
Always Ask for a Copy of the Incident Report
If you fill out an incident report, you should always ask for a copy before you leave. Some businesses will provide it immediately. Others may tell you that it will be “on file” or that you can request it later.
Here is the problem.
If you leave and try to request the report days later, some businesses will tell you they do not have to provide it to you. While they may try to deny access later, you have a much stronger position if you ask for it at the time it is created.
If you gave a statement, you should receive a copy of that statement.
Why the Incident Report Is Important
Incident reports can include critical details, such as:
- The exact location of the fall
- The condition that caused the injury
- The time and date of the incident
- Names of witnesses or employees involved
These details can become extremely important if the business later disputes what happened or claims the hazard did not exist.
Protect Yourself Early
After an injury, your focus is often on pain, shock, or embarrassment. That is completely understandable. But taking a few extra steps can make a significant difference later.
If you are injured on someone else’s property:
- Report the incident immediately
- Complete the incident report if asked
- Request a copy before you leave
Get Legal Guidance Early
