Loss of Use After a Car Accident: What You Are Entitled to Recover
After a car accident, most people know they may be entitled to a rental vehicle while their car is being repaired. What many do not realize is that if you do not use a rental car, you may still be entitled to compensation for the time you are without your vehicle. This is called loss of use.
When another driver causes an accident and your vehicle is in the shop or is not drivable, their insurance company is responsible for either providing a rental car or paying you daily compensation for the loss of your vehicle.
Loss of use typically applies when:
- Your car is in the repair shop
- Your vehicle is inoperable
- You choose not to use a rental car
Some people already have access to another vehicle, such as a spouse’s car, a spare vehicle, or a borrowed car. Even in those situations, you are still entitled to loss of use payments because you were deprived of the use of your own vehicle.
These payments usually range from $30 to $35 per day and continue until your vehicle is repaired or a total loss settlement is made.
Many insurance companies will not automatically offer this compensation. You often have to ask for it.
