Client Victory: Drunk Driving Moped Crash Leads to Finger Amputation and Serious Injuries

In this case, a drunk driving crash involving a moped left our client with catastrophic injuries, including a partial finger amputation and severe leg trauma. At first, it appeared there was no insurance coverage at all. How the Accident Happened
Our client, identified here as T.T., was a 53-year-old woman riding on the back of a moped with a friend on the evening of , around 9:30 p.m. Unbeknownst to her, the driver had been drinking and was legally intoxicated.
While driving, the intoxicated rider lost control of the moped, veered off the road, and struck a mailbox. The impact threw T.T. from the back of the moped, causing her to sustain immediate and severe injuries. Emergency responders transported her to the hospital, where doctors quickly realized her condition was critical.
Medical records noted 32 minutes of critical care, stating that failure to intervene immediately could have resulted in life-threatening deterioration.
Severe and Life-Altering Injuries
T.T.’s injuries were extensive and traumatic, including:
- A comminuted fracture of the patella (shattered kneecap)
- A large, open knee wound requiring repeated surgical cleaning
- A severe infection that later required skin grafting
- An open fracture of the distal phalanx of her right hand
- A partial traumatic amputation of her right ring finger
Skin was harvested from her right lower leg and left thigh and grafted onto the knee wound. She required multiple follow-up procedures over an extended recovery period.
Although she was wearing a helmet, which likely prevented a catastrophic head injury, the damage to her hand suggests she instinctively tried to brace herself during the fall, sacrificing her finger in the process.
A Case That Almost Went Nowhere
Initially, the case appeared bleak.
The police report stated:
- The driver was uninsured
- No passenger was listed on the report
- The driver was charged with DWI
For many attorneys, this would have been the end of the analysis. No insurance on the report often means no recovery.
