How to Get the Most Out of Your Personal Injury Case
Step Three of Our Case Maximizer Blueprint: Know All Your Injured Body Parts
One of the biggest questions people ask after an accident is simple:
How do I get the most out of my personal injury case?
At Shane Smith Law, we use what we call our Case Maximizer Blueprint. Today, we are talking about Step Three, and it is one of the most important steps of all.
Step Three: Identify Every Injured Body Part
After an accident, it is critical that you tell your doctors everything that hurts.
Too often, people focus only on the worst pain. Maybe your back hurts the most, so that is all you talk about. Or your head is pounding, so you forget to mention your shoulder, knee, or hip.
That mistake can cost you later.
Start at the Top and Work Your Way Down
When you see a doctor, we tell our clients to mentally scan their body from top to bottom and report everything, even if it seems minor.
That includes:
- Head
- Neck
- Shoulders
- Upper and lower back
- Hips
- Knees
- Legs
- Feet
If it hurts, mention it.
Why This Matters for Your Case
If an injury is not documented early, the insurance company will fight it later.
Here is what happens all the time:
- You report back pain right after the accident
- Your back improves with treatment
- Weeks later, your knee starts hurting
- You never mentioned the knee early on
The insurance company will argue the knee injury came from something else. Even if that is not true, it gives them ammunition to reduce your claim.
Be Specific About the Pain
When you talk to your doctor:
- Describe where it hurts
- Explain how it feels
- Rate the pain, whether it is mild or severe
Do not leave something out just because another injury hurts more.
Even If You Are Seeing a Specialist, Mention Everything
Another common mistake is assuming you should only talk about one body part.
For example:
- You see a knee doctor, so you only talk about your knee
- You see a shoulder specialist, so you do not mention your back
Insurance companies love this. They will later argue that your other injuries were not related because they were not mentioned at every visit.
Do not make it easy for them.
Why This Step Protects You
Listing all injured body parts early:
- Creates a clear medical record
- Prevents insurance company arguments
- Helps your legal team understand the full impact of the accident
- Puts you in the best position for full and fair compensation
This is exactly why Step Three exists in our Case Maximizer Blueprint.
