Why Isn’t the Insurance Company Paying Your Claim
A Lawsuit Waiting to Happen
One of the most frustrating calls we get is from people asking a simple question:
“Why won’t the insurance company pay my claim?”
Unfortunately, there is no single answer. The reason matters, because how we respond depends entirely on what the insurance company is actually doing behind the scenes.
Step One: Find Out What They Are Really Saying
The very first thing to identify is what stage of the process your claim is in. Insurance companies often use vague language that sounds reasonable but hides delay.
Common explanations include:
- “We are still investigating the claim”
- “We are trying to contact our insured”
- “We are reviewing liability”
- “We are denying the claim”
Each of these requires a different response. That is why clarity matters.
Always Ask for the Denial in Writing
If the insurance company is denying your claim, or delaying without a clear explanation, ask them to send their decision to you in writing.
This step is critical for two reasons.
First, it allows a lawyer to review the exact language and reasoning being used. Many denials fall apart once you see what is actually being claimed on paper.
Second, it changes the adjuster’s behavior.
Once an adjuster is asked to put a denial in writing, they have to slow down and think. They know that document may be reviewed by a lawyer, a supervisor, or even a jury one day. That alone often leads to more honest and detailed answers.
Silence and Delay Are Red Flags
Another common problem is when the insurance company simply stops responding. Calls go unanswered. Emails are ignored. Weeks go by with no updates.
That is not an accident.
When this happens, there are only two effective options:
- Ask to speak directly with the adjuster’s supervisor
- Get someone involved who knows how to apply pressure
At this stage, delay itself can become evidence of bad faith.
Why This Can Turn Into a Lawsuit
When an insurance company delays payment without justification, denies a claim without proper investigation, or refuses to clearly explain its position, that is often the beginning of a lawsuit waiting to happen.
Insurance companies have legal obligations. They are required to investigate claims reasonably and communicate honestly. When they fail to do that, they expose themselves to additional liability beyond the original claim.
Do Not Let Delay Cost You Your Case
Many people wait too long, assuming the insurance company will eventually “do the right thing.” By the time they seek help, evidence has gone stale, deadlines are closer, and leverage has been lost.
If an insurance company is denying your claim, delaying without explanation, or refusing to communicate clearly, that is the time to act.
