NTSB Push to Lower BAC Limits: A Step Toward Ending Preventable Drunk Driving Tragedies
One of the most devastating and preventable types of cases involves innocent people who are seriously injured or killed by drunk drivers. These are tragedies that should never happen, yet they continue to impact families across Georgia every year.
At Shane Smith Law, we see firsthand the lasting damage these crashes cause. That is why we support recent efforts by the National Transportation Safety Board to strengthen drunk driving laws and enforcement.
A Major Recommendation: Lowering the BAC Limit
The NTSB has called on all 50 states to lower the legal blood alcohol concentration (BAC) limit from 0.08 to 0.05 or lower.
This is not a new concept. Over 100 countries worldwide have already adopted stricter BAC limits.
Research shows that impairment can begin below 0.08, meaning drivers may already be unsafe long before they reach the current legal limit.
In Georgia alone, approximately 400 lives are lost each year due to drunk driving. Lowering the BAC limit is a meaningful step toward reducing these preventable deaths.
Stronger Enforcement Measures
Lowering the legal limit is only part of the solution. The NTSB also recommends increased enforcement, including:
- More sobriety checkpoints
- Expanded use of passive alcohol sensors
- Saturation patrols targeting high-risk areas
- High-visibility public awareness campaigns
These strategies are designed to deter drivers before they ever get behind the wheel impaired.
Accountability After a DUI Arrest
There is also more that can be done after a drunk driving offense occurs.
Recommended measures include:
- Immediate license suspension or revocation after arrest
- Mandatory participation in DUI courts
- Ongoing monitoring, treatment, and testing
- Expanded use of ignition interlock devices, requiring drivers to pass a breath test before starting their vehicle
These steps are aimed at preventing repeat offenses and keeping impaired drivers off the road.
The Reality: Resistance to Change
Despite the data and the clear need for reform, these recommendations often face opposition from special interest groups concerned about economic impact.
But the focus should remain where it belongs: saving lives and protecting families.
Why This Matters for Injury Victims
Stronger laws do more than prevent crashes. They also:
- Reduce the number of avoidable tragedies
- Strengthen accountability for impaired drivers
- Limit the arguments insurance companies use to minimize claims
- Help victims pursue full and fair compensation
Giving Victims a Voice
Real change happens when people speak up.
If you live in Georgia, consider reaching out to your elected officials and urging them to adopt these recommendations. Supporting stronger DUI laws is one of the most effective ways to honor past victims and prevent future harm.
