Serious Wreck Causes Drivers Death and Serious Injury to Passenger Case Review
Hi, I’m Shane Smith from Shane Smith Law. Today, we’re talking about a difficult and unusual client victory handled by one of our attorneys, Timothy Lewis, involving a tragic crash that resulted in a driver’s death and serious injuries to our client, JW.
How the crash happened
JW was a backseat passenger in a vehicle when the driver ran a stop sign and crashed into the side of a building. The impact was catastrophic. The driver was killed at the scene, and the remaining passengers, including JW, were seriously injured.
JW’s injuries
As a result of the crash, JW suffered:
- A broken nose
- A fractured tailbone
- Head trauma
- Soft tissue injuries to the neck and back
These were significant injuries, especially given the severity of the impact and the fatal outcome for the driver.
Complications after the crash
Shortly after the accident, JW was arrested and incarcerated. Because of this, he did not receive follow-up medical treatment beyond the emergency room visit. This created additional challenges in pursuing the claim, including limited direct communication with the client and a lack of ongoing medical documentation.
How the case was handled
Despite these obstacles, Tim was still able to build a strong case based on the seriousness of JW’s injuries and the facts of the crash itself. To move the case forward, JW’s mother was appointed to act on his behalf. She stayed in communication with JW while he was incarcerated and worked directly with our office to handle decisions and documentation.
The result
Even with no post-ER treatment and limited client contact, Tim was able to secure the full policy limits available in the case. Every dollar of insurance coverage was recovered for JW based on the severity of his injuries and the circumstances of the wreck.
Key takeaway
This case shows that serious injuries can still support a strong claim, even when treatment is limited and the situation is complicated. With the right advocacy and persistence, it is still possible to hold insurance companies accountable and secure the maximum recovery available.
