Is There a Limit on Damages After a Car Accident in Georgia?

In Georgia, there is no set cap on damages in a typical car accident case.
That means, in theory:
- You can recover the full value of your injuries
- Including medical bills, lost wages, and pain
The Practical Reality: Insurance Limits
While thereโs no legal cap, there is a real-world limit:
๐ Insurance coverage
Georgia requires drivers to carry only:
- $25,000 in minimum liability coverage
So if someone hits you and only has minimum coverage:
๐ The most their insurance will pay is $25,000
Why This Matters
Serious injuries often cost far more than that.
If the at-fault driver only has minimum coverage:
- You may not be fully compensated
- Even if your case is worth much more
How You Protect Yourself
This is where Uninsured / Underinsured Motorist (UM/UIM) coverage comes in.
Example:
- At-fault driver has: $25,000
- You have UM coverage: $100,000
