In this week’s case review, Shane Smith spoke with Carilyn Ibsen of Shane Smith Law about a serious tractor-trailer crash involving a 66-year-old client, C.P., and how uncovering hidden insurance coverage and handling Medicare issues led to a strong recovery while she was still treating.
How the Accident Happened
C.P. was stopped at a stop sign near the beach when a tractor-trailer ran the stop sign and struck her vehicle. The impact did not stop there. The trailer’s bumper caught her car and dragged it down the street for more than 200 feet.
Beyond the physical danger, the experience was terrifying. Being hit and then dragged by a tractor-trailer caused lasting psychological trauma in addition to severe physical injuries.
Severe Injuries and Emergency Surgery
C.P. was rushed by ambulance to the emergency room. Her left arm was shattered and required emergency surgery, including the placement of rods. Recovery was difficult and lengthy, involving extensive physical therapy.
When C.P. eventually came to Shane Smith Law, she was still under the care of an orthopedic specialist and was facing the possibility of a second surgery. Her injuries had not fully resolved, and her recovery was ongoing.
A Delay in Getting Help
C.P. contacted the firm nearly a year after the accident. During that time, she had been trying to deal with the insurance company on her own while also caring for her elderly mother, who has significant memory issues.
Like many clients, C.P. put everyone else first. She was not calling because she wanted compensation. She was calling because she was receiving frightening letters from Medicare demanding reimbursement for her surgery and felt overwhelmed and confused.
Taking Over the Insurance and Medicare Issues
One of the first steps was reassuring C.P. that she had done nothing wrong. Medicare issues are common in serious injury cases, and they can be handled properly once the case is resolved.
Carilyn Ibsen took over communication with the insurance companies and Medicare, allowing C.P. to focus on healing and preparing for potential future surgery. Medicare ultimately agreed to a compromise, reducing the amount it initially sought to recover, which was a huge relief for the client.
Recovering Policy Limits and Finding Hidden Coverage
The at-fault driver’s insurance policy was resolved quickly once the firm became involved, and the full policy limits were obtained. However, that was not the end of the case.
C.P. had no idea what policy limits were, how much insurance was available, or whether additional coverage applied. She was never told that her own insurance included underinsured motorist coverage.
Carilyn identified that the liability policy and C.P.’s underinsured policy were issued by the same insurance company. Despite this, the insurer never explained the existence of the second policy to C.P.
Once the underinsured claim was pursued, the firm was able to recover the maximum available under that policy as well.
Why Underinsured Coverage Matters
An underinsured motorist claim applies when the at-fault driver has insurance, but not enough to fully compensate the injured person. In this case, the liability limits were far too low to account for a shattered arm, surgery, ongoing treatment, and future care.
Underinsured coverage exists specifically to protect people in situations like this. It is coverage clients pay for every month, yet many do not realize it exists or feel guilty about using it.
A Key Lesson From This Case
This case shows how easily injured people can be misled or left uninformed by insurance companies, even when dealing with their own insurer. It also highlights the importance of understanding policy limits, underinsured coverage, and Medicare’s role in injury cases.
Most importantly, it shows that clients do not need to navigate this alone.
Final Thoughts
C.P. came to Shane Smith Law feeling confused, worried, and overwhelmed. By stepping in, handling the insurance companies, resolving Medicare issues, and identifying additional coverage, the firm was able to secure meaningful compensation while she continued focusing on her recovery.
