Why you should ask for the incident report after a slip or trip and fall
After a slip and fall or trip and fall, store employees will usually ask you to fill out an incident report right away. That report documents what happened, when it happened, and what caused your fall.
Here is something most people do not realize.
Your best chance to get a copy of that report is often you.
If you ask the manager for a copy at the time of the incident, or return to the store a day or two later and ask for it in person, it is much harder for them to say no. You are standing there as a customer who was injured in their store, and the request feels very different than when it comes from an insurance company or a lawyer.
Once a lawyer requests the report, many businesses refuse to release it. They often claim the report was created in anticipation of a lawsuit and is protected for their legal team.
That is why we encourage clients to try to request the incident report themselves, face-to-face, as soon as possible.
It can be a small step that makes a meaningful difference in protecting your claim.
