J.H. Review Podcast with Attorney John Mobley
In this week’s case review, Shane Smith spoke with John Mobley of Shane Smith Law about a recently settled motor vehicle accident case involving a young woman who suffered a serious ankle injury with long-term consequences.
How the Accident Happened
The client, referred to as JH, was involved in a severe motor vehicle accident caused by a reckless driver. The collision nearly totaled her vehicle and resulted in significant property damage. While the damage to the car was substantial, the physical injuries JH suffered were far more serious and life-altering.
A Serious Ankle Injury Requiring Surgery
JH’s primary injury was to her ankle. As the case progressed and medical evaluations continued, it became clear that surgery would be required to repair the damage. This was not a minor procedure. The surgery permanently impacted her ankle and affected her ability to move, function, and live her life the way she did before the crash.
Although surgical repair helped improve her condition, John Mobley explained that injuries of this severity rarely result in a full recovery. JH is expected to experience ongoing limitations, potential flare-ups, and the need for future maintenance care for the rest of her life. She also has permanent scarring from the surgery.
Liability Was Clear, But Damages Were Disputed
In this case, the insurance company accepted liability early. Fault for the crash was not the issue. The real fight centered on damages.
The insurer attempted to downplay the seriousness of JH’s injuries, questioned the extent of her future medical needs, and discounted the long-term impact the ankle injury would have on her daily life. This is a common tactic, especially when injuries are not immediately obvious to someone reviewing a file rather than living with the injury.
Demonstrating the True Value of the Case
To push back, the legal team focused on clearly projecting JH’s future damages. This included future medical care, reduced mobility, ongoing pain, and the day-to-day burden of living with a permanent ankle injury.
One key strategy was breaking the impact down in a way a jury would understand. Even assigning a modest daily value to the pain, limitations, and visibility of the injury showed how quickly damages could grow over the course of JH’s lifetime. When framed this way, the long-term exposure became clear.
Once the insurance company understood how the case would be presented to a jury and the potential financial risk involved, their position changed.
Full Policy Limits Tendered
After months of negotiation and presenting the full scope of JH’s injuries and future challenges, the insurance company tendered the full amount of available policy limits. This meant recovering every dollar available under the at-fault driver’s insurance coverage.
A Key Lesson From This Case
One of the biggest takeaways from this case is that injuries that may seem “small” to an insurance company can have enormous consequences for the person living with them. An ankle injury does not just affect walking. It affects work, mobility, independence, and quality of life for decades.
Breaking down future damages clearly and realistically is often what turns an undervalued case into a full recovery.
Final Thoughts
JH’s case is a powerful example of why experienced legal representation matters, especially when injuries carry long-term or lifelong consequences. Insurance companies often focus on minimizing payouts. Our job is to make sure the real human impact is fully understood and fairly compensated.
