What Happens If You Get Into a Second Accident During Your Case?
Hi, I’m Shane Smith from Shane Smith Law.
One question we hear more often than you might expect is:
“What happens if I get into another accident while my case is still ongoing?”
It happens more than people think. And while it does not ruin your case, it does make things more complex.
1. Yes, You Can Have Two Claims
If you are involved in two separate accidents:
- You have two separate claims
- There are two insurance companies
- There are two at-fault parties
Both cases can move forward.
2. The Key Issue: Separating the Injuries
The biggest challenge is determining:
Which injuries and treatment belong to which accident
This depends heavily on your condition between the two incidents.
3. When It Is Easier to Separate
If you were mostly recovered from the first accident before the second:
- Pain was minimal
- Treatment was nearly complete
Then it is usually easier to assign:
- New injuries → second accident
- Earlier injuries → first accident
4. When It Gets Complicated
If you were still actively treating when the second accident happened:
- Pain was ongoing
- Treatment had not finished
Then the cases can overlap.
This creates challenges because:
- The first insurance company may blame the second accident
- The second insurance company may blame the first
In some situations, certain medical bills may need to be presented to both carriers.
5. Different Scenarios
Every case is different:
- Minor second accident: May not create a meaningful new claim
- Severe second accident: May clearly account for most of the injuries
- Overlapping injuries: Require careful legal and medical analysis
6. Focus on Your Recovery
The most important thing we tell our clients:
Focus on getting better.
- Continue your treatment
- Follow your doctor’s recommendations
- Do not stop care just because there is a second accident
Your legal team can handle:
- Communicating with both insurance companies
- Working with doctors to allocate injuries
- Building both claims properly
7. Does It Ruin Your Case?
No.
It may:
- Complicate the case
- Require more work
- Make things more detailed if it goes to trial
But it does not eliminate your right to recover.
8. Should You Use the Same Lawyer?
In most situations, yes.
Using the same attorney can help because:
- They already understand your medical history
- They have all your records
- They can coordinate both claims efficiently
If the second accident happens in another state, coordination between attorneys may be needed.
9. Always Tell Your Lawyer
Insurance companies will find out about the second accident.
It is important that you:
- Tell your attorney immediately
- Be transparent about what happened
This allows your case to be handled correctly from the start.
Final Thoughts
Multiple accidents can make a case more complex, but not impossible.
With the right approach, both claims can still be pursued effectively.
