Why Insurance Companies Ask If You Have Health Insurance in North Carolina
When you are hurt in an accident in North Carolina, one of the first questions the insurance company asks is whether you have health insurance. That question is not casual, and it is not harmless.
There is a very specific reason they want to know.
Why Health Insurance Matters to Your Claim
In North Carolina, insurance companies are allowed to reduce certain medical bills if those bills were paid or discounted by health insurance.
For example, if you have a large emergency room bill and your health insurance pays a reduced amount, the insurance company may argue that only the reduced amount should count toward your claim. That can directly lower the value of your case.
On the other hand, if you do not have health insurance and the medical bills were never reduced, the insurance company is not automatically entitled to apply those discounts.
That difference matters.
What Is a “No Health Insurance” Affidavit?
If you do not have health insurance, the insurance company will often require proof. In those situations, we may ask you to sign what is called a No Health Insurance Affidavit.
This is a simple legal document that states:
- You did not have health insurance at the time of treatment
- Your medical bills were not paid or reduced by an insurer
Years ago, insurance companies often accepted a lawyer’s statement. Today, they usually do not. They require this affidavit as part of the claims process.
Why It Must Be Notarized
The insurance company will not accept the affidavit unless it is notarized. That means you must sign it in front of a notary public and show valid identification.
If you are unsure where to find a notary, common options include:
- Your bank
- A UPS Store
- Some post offices
Once it is notarized, you simply return it to our office and we handle the rest.

This affidavit protects the full value of your medical bills and prevents the insurance company from unfairly reducing your claim. While it may feel like extra paperwork, it can make a real difference in the outcome of your case.
