A class action claim against the manufacturer of a toilet-flushing mechanism could create premises liability claims. The class action suit requesting $5 million in damages was filed after toilets exploded due to malfunctioning flushing mechanisms. The toilets were recalled by the federal Consumer Product Safety Commission (CPSC). As a result, premises liability claims could be filed if owners of the exploding toilets do not have them repaired. According to published reports the toilets have led to 14 reports of lacerations and other injuries. One victim had 14 stitches in his posterior due to an exploding toilet. The Flushmate III Pressure-Assist toilet sold over 2 million units in the United States prior to its recall. The CPSC reported that a defective water conservation device causes the toilets to explode.

A premises liability suit could be filed if a business owner has a known malfunctioning device after a recall has been issued. A person who is injured could bring suit against the property owner for knowingly having a dangerous toilet.
