A 37-year-old deliveryman in another state sued a city after he was struck by a falling tree branch while riding his bicycle. The branch fell more than 20 feet and struck the man in the back, paralyzing and him and requiring him to have 24-hour assistance for the remainder of his life.

According to the plaintiff, the city had received multiple complaints about the tree in question, including one just six weeks prior to the accident. Attorneys for the plaintiff contended that the city dramatically reduced its tree-trimming services prior to the incident, thereby impacting the city's ability to inspect and address the tree's issues.

The city claimed it had sent inspectors to the tree twice. The plaintiff's attorneys argued that the first inspection never took place and the second lasted only two minutes, an insufficient amount of time to determine the tree's problems.

Prior to the trial the parties reached a settlement for $5.75 million.
